PLEASE READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE.
1. Risks. I am visiting AWKN Ranch and may take part in activities including the pool, sauna, steam, salt room, cold plunge, trails and farm, fitness and yoga, breathwork, meditation and ceremony, overnight lodging, food service, and events. I understand these carry inherent risks that cannot be eliminated — including drowning, slips and falls, overheating, cold shock, cardiac events, fainting, uneven and unlit terrain, wildlife, insect bites, allergens, intense emotional experience, illness, injury, and death. This list is not complete. I am choosing to participate anyway.
2. I am fit to participate. I am in good enough physical and mental health to take part, I am not impaired by alcohol or drugs, and I will stop or leave any activity if I feel unwell. AWKN is not my medical provider for these activities, has not examined me, and is relying on my word.
3. ASSUMPTION OF RISK. I KNOWINGLY AND FREELY ASSUME ALL RISK OF INJURY, ILLNESS, DISABILITY, DEATH, AND PROPERTY LOSS ARISING FROM MY PRESENCE AT AWKN RANCH, WHETHER KNOWN OR UNKNOWN, AND WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF AWKN.
4. RELEASE — INCLUDING AWKN'S OWN NEGLIGENCE. I RELEASE, WAIVE, AND FOREVER DISCHARGE HEART SPACE HEALTH INC., ITS OWNERS, EMPLOYEES, CONTRACTORS, FACILITATORS, AGENTS, AFFILIATES, AND THE PROPERTY OWNERS FROM ALL CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING FROM MY PRESENCE AT AWKN RANCH.
I SPECIFICALLY INTEND THIS RELEASE TO COVER CLAIMS CAUSED IN WHOLE OR IN PART BY AWKN'S OWN NEGLIGENCE, INCLUDING NEGLIGENT SUPERVISION, INSTRUCTION, HIRING, PREMISES MAINTENANCE, AND RESCUE.
THIS DOES NOT COVER GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, OR ANYTHING THAT CANNOT BE RELEASED UNDER TEXAS LAW.
5. INDEMNITY. I AGREE TO INDEMNIFY AND HOLD AWKN HARMLESS FROM ANY CLAIM, LOSS, OR COST (INCLUDING ATTORNEYS' FEES) BROUGHT BY ME OR ON MY BEHALF, INCLUDING CLAIMS ARISING FROM AWKN'S OWN NEGLIGENCE, BUT NOT ITS GROSS NEGLIGENCE OR INTENTIONAL MISCONDUCT.
6. Emergency care. If I cannot consent, I authorize AWKN to arrange emergency medical care at my expense.
7. Rules, media, property. I will follow posted rules and staff instruction. AWKN may photograph at the property and use my image in its marketing. AWKN is not responsible for lost or stolen belongings.
8. Texas law. This Agreement is governed by Texas law, with venue exclusively in Travis County. If any part is unenforceable, the rest stands.
9. IF SIGNING FOR A MINOR. I am the parent or legal guardian, I agree to all of the above on my own behalf and the minor's, and I will indemnify AWKN against any claim brought on the minor's behalf.
I HAVE READ THIS AGREEMENT. I UNDERSTAND I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE AWKN FOR ITS OWN NEGLIGENCE. I SIGN IT FREELY.
